These Terms govern access to and use of the Nextotalk website and platform. By using the service, you agree to these Terms and the Privacy Notice.

1. Acceptance

By accessing or using Nextotalk, you confirm that you have read and accepted these Terms. If you do not agree, you must not use the platform.

2. Service description

Nextotalk is a customer-conversation platform that helps businesses centralize channels, automate workflows, hand off to human agents, and operate third-party integrations based on each business configuration.

3. Accounts and access

  • The customer is responsible for the accuracy of onboarding and account data.
  • The customer must safeguard credentials and notify unauthorized access immediately.
  • Nextotalk may limit or suspend access when security risk or misuse is detected.

4. Permitted use

You agree not to use the service for:

  • Illegal, fraudulent, or abusive activities.
  • Spam, malicious content, or attempts to disrupt service availability.
  • Infringing third-party rights, including intellectual property and data protection rights.

5. Third-party integrations

Nextotalk may integrate with third-party services, including Meta platforms (such as WhatsApp, Instagram, Messenger) and Google Calendar when enabled by the customer.

  • Use of third-party services is also subject to their own terms and policies.
  • Customers are responsible for account status, permissions, and credentials in each integration.
  • Nextotalk is not responsible for external provider outages, restrictions, or policy changes.

6. Privacy and personal data

Personal data processing is governed by the current Privacy Notice. Customers are responsible for having lawful grounds to process end-user data where required.

7. Availability and maintenance

We strive for continuous availability, but maintenance windows, updates, and technical adjustments may temporarily impact service.

8. Fees and billing

Nextotalk fees are defined by the subscribed plan or commercial agreement. Third-party channel or calendar costs are governed by each provider.

9. Intellectual property

Nextotalk software, trademarks, and content are protected by applicable law. These Terms do not transfer ownership rights to users.

10. Limitation of liability

Nextotalk is not liable for indirect damages, loss of profits, loss of data, or impacts caused by factors outside reasonable control, including third-party service failures and incorrect platform use.

11. Suspension and termination

Nextotalk may suspend or terminate service for material breach, security risk, or legal requirement.

12. Changes to terms

We may update these Terms at any time. The latest version will be published on this website.

13. Governing law and jurisdiction

These Terms are interpreted under applicable Mexican law. Jurisdiction will be determined by competent courts in Mexico City, unless mandatory law provides otherwise.
